Terms & Conditions

These Terms and Conditions (“Terms”) apply to all services provided by Dreamway Construction Limitedto our clients  By engaging our services, you agree to these Terms.

1. Services

We provide building, renovation, and related construction services as agreed in writing with you (including quotes, contracts, or project agreements).

2. Quotes and Pricing

• All quotes are estimates based on the information provided.
• If extra work is required (due to unforeseen issues, variations, or changes requested by you), additional charges may apply.
• Prices shown are in NZD, GST exclusive.

3. Payments

• A deposit may be required before work begins.
• Progress payments may be requested for longer projects.
• Final payment is due upon completion of the work.
• Late payments may incur interest or recovery costs.

4. Client Responsibilities

You agree to:

• Provide accurate information and access to the site.
• Ensure the site is safe for our workers and subcontractors.
• Obtain any necessary approvals (e.g., council consents), unless agreed otherwise.

5. Our Responsibilities

We will:

• Carry out the work with reasonable skill, care, and in accordance with NZ building standards.
• Use qualified tradespeople and reputable materials.
• Make reasonable efforts to meet agreed timeframes (delays may occur due to weather, supply issues, or unforeseen circumstances).

6. Subcontractors and Suppliers

We may engage subcontractors and suppliers to complete parts of the project. We remain responsible for their work as part of our service.

7. Warranties and Liability

• We comply with the Consumer Guarantees Act 1993 and the Building Act 2004 (including implied warranties for building work).
• We are not liable for delays or costs caused by factors beyond our control (e.g., extreme weather, supply shortages, council delays).
• To the maximum extent permitted by law, we are not responsible for indirect or consequential losses.

8. Variations

Any changes to the agreed scope of work must be confirmed in writing and may affect pricing and timelines.

9. Cancellation

If you wish to cancel the project:

• Deposits may not be refundable once materials or labour have been committed.
• We may charge for work already completed and costs incurred.

10. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the New Zealand courts.
